The services provided by RealChinaTrip refer to the products and services offered by RealChinaTrip when you access this website, purchase or use RealChinaTrip products or services, use the RealChinaTrip mobile app, or use any software related to the aforementioned services provided by RealChinaTrip.

1.2 Your agreement with RealChinaTrip

The "Terms of Use" you sign with RealChinaTrip does not fully list or cover all the rights and obligations you have with RealChinaTrip, and existing agreements may not fully meet future needs. Therefore, any additional terms, rules, and RealChinaTrip's privacy policy ("Privacy Protection Policy") related to the service are supplementary agreements to this "Terms of Use" and are inseparable and have the same legal effect. By using RealChinaTrip services, you agree to these supplementary agreements.

2. Changes to the "Terms of Use"

2.1 RealChinaTrip Modifications

2.1.1 RealChinaTrip reserves the right to modify or update these "Terms of Use" at any time. You should regularly check the latest version of the "Terms of Use." If RealChinaTrip modifies or updates these terms, the changes or revisions will be notified in advance on this page and its relevant pages. The revised or updated "Terms of Use" will automatically take effect seven days after being published on this page and related pages. The date of the most recent revision is displayed at the bottom of this page.

2.1.2 If you continue to use this website's services after the changes or updates become effective, you agree to and accept the revised or updated "Terms of Use." 3. Use of Services

3.1 User Eligibility

3.1.1 You confirm that, before you begin the registration process to use RealChinaTrip services, you must have the civil capacity required by the laws of your country that corresponds to your actions. If you lack the appropriate civil capacity for your actions, you and your guardian shall bear all consequences under the law. Additionally, you must ensure that you are not subject to any trade restrictions, economic sanctions, or other legal or regulatory restrictions imposed by international, regional, or international organizations, and that you do not directly or indirectly provide funding, goods, or services to signatories. If you do, you should stop using RealChinaTrip services.

3.1.2 For users in Hong Kong SAR, you must be at least 18 years old or have obtained consent from your parent or legal guardian to use RealChinaTrip services. All transactions conducted through your account will be deemed to have been made by you or with your authorization.

3.2 Use of Services

3.2.1 Under the terms of this "Terms of Use," the services you select on this website are for your personal use only. You may not provide them to any third party or derive any benefits from them. "Services" includes, but is not limited to, accessing this website and using any services provided by RealChinaTrip either directly or on behalf of other operators.

3.2.2 You fully understand and agree that, except as otherwise stipulated in this agreement, due to the nature of internet services, RealChinaTrip may change, interrupt, or partially or fully discontinue its network services. RealChinaTrip will not bear any responsibility for this, though it will notify you in advance as much as possible.

3.2.3 You fully understand and agree that, because the service involves the internet and mobile communications, RealChinaTrip cannot guarantee immunity from instability at various stages. Therefore, RealChinaTrip is not responsible for any service interruptions, cancellations, or terminations due to force majeure, computer viruses, hacker attacks, system instability, user location, user shutdowns, GSM networks, the internet, communication lines, or other factors that RealChinaTrip cannot predict or control. RealChinaTrip will not be liable for any losses resulting from such events.

4. Ownership and Intellectual Property

4.1 User-Uploaded Materials

4.1.1 Once you accept this agreement, you grant RealChinaTrip an irrevocable, global, transferable, exclusive license to use the copyright (including, but not limited to, the right to copy, distribute, rent, exhibit, perform, broadcast, communicate over the network, film, adapt, translate, compile, and any other rights granted to copyright holders), portrait rights, user ID name, and all related legal rights in the materials you provide, upload, create, or publish on this website in any form, including but not limited to customer reviews, customer inquiries, topic articles, and more. RealChinaTrip has the right to store, use, copy, modify, edit, publish, display, translate, distribute, promote, publish, issue, and communicate your materials, as well as create derivative works based on them. These materials may be incorporated into other works in any form, medium, or technology, whether known or developed in the future.

4.1.2 You must ensure that the materials you publish on this website do not infringe upon third-party portrait rights, privacy rights, intellectual property, or other legal rights. Otherwise, RealChinaTrip has the right to take actions including but not limited to deleting or disconnecting links.

4.2 Intellectual Property

4.2.1 All content provided or included in RealChinaTrip services, such as text, data, images, articles, photos, videos, illustrations, films, sound effects, and other materials (collectively "Content"), belongs to RealChinaTrip or is used under full authorization from content providers, and is protected by applicable copyright law, international treaties, and other relevant intellectual property laws. You may not illegally use, copy, modify, adapt, create derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast, repost, cite, link, scrape, or otherwise exploit any content from this website.

5. User Representations, Warranties, and Commitments

5.1 Use of the Website and Services

5.1.1 You represent, warrant, and commit to RealChinaTrip that you will not provide any user materials to third parties or use this website or services in the following ways: (a) infringing on any third party’s intellectual property or other proprietary rights, privacy rights, or other rights; (b) violating any applicable laws or regulations; (c) engaging in harmful, fraudulent, false, threatening, abusive, harassing, defamatory, obscene, or otherwise unacceptable behavior; (d) engaging in commercial activities or sales, such as contests, lotteries, transactions, advertising, or marketing, without prior written consent from RealChinaTrip; (e) defaming or impersonating any individual or legal entity, including but not limited to any employees or representatives of RealChinaTrip; or (f) introducing viruses, malware, trojans, worms, "time bombs," or other harmful computer codes, files, or programs.

5.2 User Submission of Materials Responsibility

5.2.1 You are solely responsible for any materials you upload, publish, or transmit via email on this website.

5.2.2 You declare and agree that you are solely responsible for the materials you submit and for the publication of these materials on this website, and you represent, warrant, and commit to RealChinaTrip that: (a) You own or have explicit rights, authorization, or consent to use and grant RealChinaTrip the rights to use your submitted materials, including all copyrights, trademarks, or other intellectual property rights, and (b) the materials you submit or publish do not infringe upon any third-party intellectual property or violate any applicable laws.

5.2.3 You further agree that you are solely responsible for all activities related to your use of this website and/or RealChinaTrip services. You further represent, warrant, and commit that you will not: (a) engage in fraudulent, abusive, or illegal activities, (b) sell or resell any products, services, or bookings obtained from this website, or (c) use this website for commercial purposes or activities that compete with RealChinaTrip.

5.2.4 You are responsible for maintaining records and paying any taxes or government fees related to the services provided through this website.

6. Account Registration and Security

6.1 Registering a RealChinaTrip Account

6.1.1 To use the services, you may need to register and maintain a RealChinaTrip account ("RealChinaTrip Account"). You are responsible for all activities conducted through your account, and you may not transfer or authorize others to use your account.

6.2 Providing Personal Information

6.2.1 You must provide accurate, complete, and up-to-date information for your RealChinaTrip account. Failure to do so will be considered a violation of these "Terms of Use," and may result in the termination of your account.

6.2.2 You agree not to use someone else’s name or impersonate others when choosing your RealChinaTrip user ID.

6.2.3 RealChinaTrip reserves the right to refuse registration or cancel a RealChinaTrip account.

7. Reviews

7.1 To complete your order, you agree to receive booking confirmation notifications (via email and/or mobile app notifications) and agree to receive an invitation via email or mobile app notification to leave a review after completing the activity order. You may choose whether or not to fill out the review. Confirmation notifications and activity review invitations are part of the booking process and are not part of advertising or marketing. Completed user reviews will be uploaded to the relevant activity page on the RealChinaTrip platform within 72 hours to inform future users of your opinion on the service quality and standards of the activity. After completing a review, your account will earn RealChinaTrip points, which can be used for future activity bookings, subject to terms and conditions. Regardless of whether you book one or multiple activities, each account can only leave one review per month. If any account is found to have obtained points fraudulently or through misuse, RealChinaTrip may deduct points directly from the RealChinaTrip account without prior notice.

7.2 By posting a review, you grant RealChinaTrip the right to use all user-generated content in a complete, permanent, free, transferable, and irrevocable manner. RealChinaTrip has the right to edit, adjust, refuse, or delete the content at its discretion.

7.3 You confirm that you will comply with the user review guidelines and represent and warrant that: 7.3.1 You own or otherwise control all rights to the content you post; 7.3.2 The content is accurate and not misleading; and 7.3.3 The use, publication, or distribution of the content does not violate these terms or any applicable laws or regulations, does not infringe any third-party rights, and does not cause harm to any third party.

7.4 Reviews may not contain obscene, offensive, blasphemous, hateful, or inciting content, nor may they include personal information of others (such as names, phone numbers, or email addresses), or unrelated content such as promotional/invitation/reward information. Additionally, reviews may not contain defamatory, abusive, or harassing content, or infringe on others' legal rights.

7.5 You grant RealChinaTrip the right to take legal action against individuals or entities that violate these terms or infringe on your or RealChinaTrip's rights. You agree that you are solely responsible for the content you provide or submit.

7.6 User-submitted content is considered non-confidential, and RealChinaTrip has no obligation to treat it as proprietary. Additionally, RealChinaTrip reserves the right to use this content, including but not limited to deleting, editing, modifying, rejecting, or refusing to publish it. RealChinaTrip has no obligation to pay you any compensation for the submitted content, and once submitted, RealChinaTrip is not obligated to provide opportunities to edit, delete, or modify published content. RealChinaTrip has no obligation to provide attribution for this content or to enforce third-party attribution rights.

8. Order Confirmation, Tickets, Vouchers, Fees, and Payments

8.1 Order Confirmation
8.1.1 Some designated activities or services offer real-time confirmation. For activities or services that do not fall into this category, the confirmation time mentioned on the website is for reference only. The actual confirmation time may vary depending on the specific circumstances.

8.2 Purchase and Use of Vouchers
8.2.1 When you book services provided by destination suppliers through the website, confirmation will be in the form of an electronic voucher (hereafter referred to as "voucher"). Under the supplier's terms and conditions, you will receive a confirmation email that includes a confirmation code (hereafter referred to as "confirmation code") and a printable version of the voucher.
8.2.2 To use your voucher, you must personally arrive on time at the designated meeting point of the supplier and provide any documents and/or information the supplier may require, which may include your confirmation code and/or a printed copy of your voucher. If you do not arrive on time or fail to provide the necessary documents and/or information, you will not receive the service or a refund.
8.2.3 The supplier may require you to provide a photo ID to use your voucher. You should keep your voucher and confirmation code safe. You agree and acknowledge that if your voucher or confirmation code is lost, damaged, or stolen, neither RealChinaTrip nor the supplier is liable. Additionally, if the provision of the service is prohibited by law, the voucher will become invalid. If you attempt to redeem the voucher in an unlawful manner (e.g., attending a wine-tasting activity but not meeting the legal age requirements), the supplier may refuse to accept your voucher and is not obligated to arrange a refund.

8.3 Voucher Usage Conditions
8.3.1 The conditions for using each voucher may vary depending on the supplier. Any restrictions (including but not limited to age requirements) will be communicated to you at the time of booking.
8.3.2 A voucher serves as a one-time entry ticket to a particular activity (referred to as "activity"). The voucher will indicate the period during which it is valid. If you do not use the voucher within the specified period, unless otherwise stated on the voucher, it will not be eligible for a refund.

8.4 Voucher Cancellation
8.4.1 You can contact RealChinaTrip's customer service within the cancellation period specified on the website to cancel your voucher. The cancellation window varies by case. Once the cancellation is successful and you receive the necessary notification, the amount will be refunded in full to the payment method used at the time of booking.
8.4.2 The final service provider for the activity is the supplier, not RealChinaTrip. The supplier has the right to independently accept or refuse your voucher and is responsible for providing all related services.
8.4.3 If you have any questions or complaints regarding the services related to the voucher, please contact the relevant supplier. Unless explicitly stated in these Terms of Service, all fees paid for vouchers are non-refundable. The booking price is determined based on the rate specified on the website at the time of booking.
8.4.4 If the supplier cancels the activity you booked, RealChinaTrip will notify you as soon as possible and will refund the amount in full to the payment method used at the time of booking.

8.5 Request for Assistance
8.5.1 If you attempt to redeem or use a voucher according to these Terms of Service and the relevant usage conditions but are unsuccessful (due to the supplier's fault or other reasons), please contact RealChinaTrip at support@RealChinaTrip.com. RealChinaTrip will attempt to liaise with the supplier to resolve the issue.

8.6 Additional Fees
8.6.1 RealChinaTrip reserves the right to request payment for any services provided. You should pay all applicable fees for the service you select according to the instructions on the website.

8.7 Fee Changes
8.7.1 RealChinaTrip reserves the right to change prices and charges at any time, and such changes may be communicated via email or posted on the website. If you continue to use the service after such changes, it means you accept and agree to the revised prices and charges.

8.8 RealChinaTrip's Rights and Obligations
8.8.1 RealChinaTrip reserves the right to refuse or cancel any service order or booking that may violate these Terms of Service.
8.8.2 RealChinaTrip strives to offer the best market prices or negotiate the best prices with suppliers. You acknowledge and agree that the best price explicitly does not include all taxes or additional fees for the service.
8.8.3 Although RealChinaTrip requests that suppliers provide accurate and up-to-date pricing for services, RealChinaTrip cannot guarantee that the prices offered by suppliers are always accurate.

8.9 The above Terms of Service and refund policies apply to all RealChinaTrip users worldwide.

9. Discounts

9.1 RealChinaTrip Promo Codes
9.1.1 RealChinaTrip promo codes are one-time use codes sent to you via email or directly credited to your RealChinaTrip account. When booking through RealChinaTrip, using a promo code allows you to enjoy a discount. Please note that if a promo code has been used during booking, it cannot be refunded or returned even if you request a refund or experience other issues.
9.1.2 RealChinaTrip promo codes can be obtained as follows: (a) as described in Article 11, you may receive a promo code through the invitation program; or (b) RealChinaTrip may grant you a promo code at its discretion for various reasons.

9.2 Abuse of Discounts
9.2.1 If RealChinaTrip discovers that you have obtained RealChinaTrip points or promo codes fraudulently, or in violation of these Terms of Service, or by any method not approved by RealChinaTrip, RealChinaTrip reserves the right to: (a) immediately terminate your RealChinaTrip account; (b) cancel any previously earned points or promo codes; (c) refuse to provide services to you; or (d) take any other action that RealChinaTrip deems reasonable.

10. Referral Discount Program

10.1 Program 

10.1.1 RealChinaTrip may offer opportunities for discounts or special offers on certain websites to members who invite friends to become members of RealChinaTrip via authorized invitation channels and make successful bookings (e.g., via RealChinaTrip’s website/Facebook or other social media channels). Members will receive a referral discount when a friend successfully registers and makes a booking.

10.2 Conditions 

10.2.1 You may only receive referral discounts through authorized member invitation methods by RealChinaTrip. Invitations made outside of authorized channels will not qualify for any referral discounts. You understand that referral discounts are non-transferable, non-auctionable, non-negotiable, and cannot be shared with other members. 

10.2.2 You will receive the referral discount only when your friend completes their first valid booking on the RealChinaTrip website via an authorized invitation channel. If your friend does not follow the instructions in the invitation email or other valid invitation methods, you will not receive the referral discount. RealChinaTrip assumes no responsibility for this. 

10.2.3 You agree that holding multiple RealChinaTrip accounts violates these Terms of Use. Sending invitations to other email addresses or accounts, or attempting to circumvent the RealChinaTrip referral program, may result in the loss of your membership and all referral discounts in your account. These actions do not affect RealChinaTrip’s other rights or remedies. 

10.2.4 You may not independently promote our referral discount program. You may not represent RealChinaTrip in any promotional, marketing, or advertising activities, including using RealChinaTrip’s trademarks. 

10.2.5 If we suspect that the invitee or the referral discount has been obtained through fraud, a violation of these Terms of Use, or any method not agreed upon by RealChinaTrip, we reserve the right to cancel the invitee’s membership and any referral discounts obtained. 10.2.6 Once the qualified invitee successfully makes their first booking, RealChinaTrip will send the referral discount to your account within approximately 24 hours. 

10.2.7 RealChinaTrip reserves the right to modify the referral program's discount details based on each user's behavior. 

10.2.8 RealChinaTrip reserves the right to adjust or terminate the referral discount program at any time. If the accumulation or use of referral discounts results in any tax liabilities, participants must fulfill these obligations themselves. You understand that your account may not correctly display the actual referral discounts obtained, and RealChinaTrip is not responsible for any errors in your account.

11. Privacy Protection Policy

11.1 Privacy Protection 

11.1.1 For policies regarding RealChinaTrip’s use of your personal data, please read our current Privacy Protection Policy, which is incorporated into these Terms of Use. By accepting these Terms of Use, you agree to the Privacy Protection Policy and are bound by it.

12. Indemnification

12.1 Indemnity Clause 

12.1.1 You agree to indemnify and hold harmless RealChinaTrip, its parent company, subsidiaries, affiliates, executives, directors, and employees from any loss or claims (including but not limited to losses, liabilities, settlement fees, litigation costs, and attorney fees) arising from third-party claims due to your actions or the use of your RealChinaTrip account, including violations of these Terms of Use or intellectual property infringement.

12.2 RealChinaTrip’s Involvement 

12.2.1 If necessary, RealChinaTrip will participate in the defense of any claims or legal actions, as well as any settlement negotiations. You may not make any settlement that could negatively affect RealChinaTrip’s rights or obligations without prior written permission. RealChinaTrip reserves the right to defend and control any claims or legal actions independently.

13.3 Disclaimer of Liability

13.3.1 In no event shall this website / RealChinaTrip's parent company / subsidiaries / affiliates / executives / directors and/or employees be liable for any loss, or any indirect, special, incidental, or punitive damages arising from or related to any of the following: (a) this website; (b) these Terms of Use; (c) your or any third party's breach of these Terms of Use; (d) any actual or attempted communication or transaction between users, even if we have been advised of the possibility of such damages.

13.3.2 Regardless of whether the damages arise from: (a) breach of contract; (b) breach of warranty; (c) strict liability; (d) tort; (e) negligence; or (f) any other legal cause, the above limitations and exclusions shall apply to the fullest extent permitted by applicable law.

13.3.3 To the fullest extent permitted by applicable law, RealChinaTrip makes no express or implied representations or warranties, including but not limited to regarding the content/software/information/services/products/functionalities provided on this website or through third-party hyperlinks, or the security responsibility related to transmitting sensitive information via this website, or the ability and conduct of third-party operators, or whether the features or any information or content on this website will be uninterrupted or accurate.

13.3.4 You understand and agree that any transmission to or from this website, or content transmitted by this website, is not confidential, and that your transmitted content may be read or intercepted by others. You further understand and agree that any content transmitted between you and RealChinaTrip, and any information you post on this website, including travel itineraries and/or activities, shall not create any confidentiality/trust/implicit contractual relationship or any other relationship between you and RealChinaTrip, except as governed by these Terms of Use.

13.3.5 You understand and agree that you will not hold RealChinaTrip liable or attempt to hold RealChinaTrip responsible for any content provided by any other third-party operator, and you further understand and agree that RealChinaTrip is not a party to any transactions involving third-party services provided by other operators. RealChinaTrip has no control over the security of any transactions/itinerary/activities on this website, nor the truthfulness or accuracy of any links or other content provided by third-party operators, and does not provide any guarantees in this regard.

13.4 Remedies 

13.4.1 If you are dissatisfied with this website or any part of these Terms of Use, or if you have any disputes related to these Terms or this website, your only remedy is to stop using the website.

14.1 Links to Third-Party Websites

14.1.1 This website may contain links to third-party websites or services that are not owned or controlled by RealChinaTrip (hereinafter referred to as "Third-Party Websites"). The presence of a link to a Third-Party Website does not imply that RealChinaTrip endorses or recommends such Third-Party Websites and/or the information, products, advertisements, or other materials available on those Third-Party Websites.

14.1.2 When you visit a Third-Party Website, you do so at your own risk. You represent and warrant that you have read all applicable policies related to the services provided by any Third-Party Websites you use and agree to comply with those policies. In addition to your obligations under these Terms of Use, you must also adhere to all applicable policies of any Third-Party Website.

14.1.3 RealChinaTrip has no control over the content, accuracy, privacy policies, or activities of Third-Party Websites, nor does it endorse any opinions expressed on such sites. Furthermore, RealChinaTrip does not, and cannot, monitor, verify, review, or edit the content of any Third-Party Websites. By using RealChinaTrip's services, you agree to hold RealChinaTrip harmless from any liability arising from your use of any Third-Party Websites.

14.1.4 If you interact with any third parties (including but not limited to other operators) through RealChinaTrip’s services, including the payment and delivery of products or services, as well as any other terms, conditions, warranties, or representations related to such transactions, these interactions are solely between you and the third party, and RealChinaTrip is not involved.

14.1.5 Before engaging in any online or offline transactions with any of the aforementioned third parties, you should conduct any investigations you deem necessary or appropriate.

14.2 RealChinaTrip’s Responsibility

14.2.1 You agree that RealChinaTrip is not liable for any loss or damage arising from such transactions. In the event of a dispute between the parties involved in the website or between a user and any third party, you understand and agree that RealChinaTrip has no obligation to get involved. If you have any disputes with one or more other users or third parties, you hereby release RealChinaTrip, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, and successors from any known or unknown, foreseeable or unforeseeable claims, demands, and damages (including actual and potential) arising from or related to such disputes.

15. Termination

15.1 Termination by RealChinaTrip

15.1.1 These Terms of Use will remain in full force and effect as long as you use this website or its services. If you violate any of the terms or conditions of these Terms of Use, RealChinaTrip may immediately terminate or suspend your access to this website and its services, without any liability on the part of RealChinaTrip.

15.2 Effect of Termination

15.2.1 Upon termination of your account, your right to access this website, use the services, and any content will immediately cease. However, any provisions in these Terms of Use that, by their nature, should remain in effect after termination will continue to apply, including but not limited to ownership clauses, disclaimers, and limitations of liability.

15.2.2 If these Terms of Use are terminated due to your breach, RealChinaTrip reserves the right to cancel any unused vouchers that you have purchased prior to termination, without refund or liability.

16. Passport, Visa, Driver's License, Insurance, and Related Documents

16.1 Your Responsibility

16.1.1 Regardless of nationality or destination, all users are responsible for consulting the relevant consulate of the country they will visit to check the current entry requirements. You are also responsible for ensuring that you have the appropriate type of driver's license and any other documents required by local regulations.

16.1.2 Since visa and health inspection requirements may change without notice, we recommend that you consult the specific consulate for up-to-date information on health checks and visa regulations before your departure.

17. Governing Law and Jurisdiction

17.1 Governing Law

17.1.1 These Terms of Use shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong SAR") without regard to its conflict of law provisions.

17.1.2 You agree that any dispute arising from or relating to these Terms of Use or your use of RealChinaTrip services shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

17.1.3 If you are accessing or using our services as a consumer, the mandatory consumer protection laws of your country of residence may provide you with additional rights. Nothing in these Terms of Use shall affect your rights as a consumer under Hong Kong law or any other applicable mandatory consumer protection laws.

17.2 Compliance with Laws

17.2.1 You agree to comply with all applicable laws and regulations in Hong Kong SAR and any other relevant jurisdictions when using RealChinaTrip services.

17.3 By using RealChinaTrip's services, you agree to these Terms of Use.

 

18. Miscellaneous

18.1 Severability 

18.1.1 If any part of these Terms is deemed unenforceable, the remainder of the Terms will still be valid and enforceable.

18.2 Assignment 

18.2.1 You may not assign or transfer these Terms without prior written consent from RealChinaTrip, though RealChinaTrip can assign or transfer them at its discretion.
